Disciplinary Counsel David M. Lame
Counsel for Respondent
Decision Date 2001-12-19
Effective Date 2002-06-12
Case Digest Respondent was convicted of driving under the influence of alcohol. Respondent failed to report his conviction to the Executive Director and Secretary, Office of Disciplinary Counsel initiated a formal proceeding which was heard by a Hearing Committee who recommended that an Informal Admonition would suffice as an appropriate disciplinary sanction. Office of Disciplinary Counsel did not take exception to the Report and Recommendation and the Disciplinary Board, in conducting a de novo review, determined that the matter would best be resolved by the imposition of a Private Reprimand with probation. The difficulty with the probation was that Respondent relocated out of the Commonwealth of Pennsylvania and Office of Disciplinary Counsel had a concern with how the probation would be monitored and enforced. The Disciplinary Board also included as a condition of probation for the appointment of a sobriety monitor. The matter was concluded by a Private Reprimand with a period of one-year probation and the imposition of a sobriety monitor.
