This matter was based upon Respondent’s criminal conviction for criminal trespass, possession of an interception device, and interception of oral communications. Respondent was sentenced to five years probation for each of the three charges, to be served concurrently. The Board concluded that Respondent suffered from a psychiatric disorder which was related to his misconduct, and he was therefore entitled to mitigation. However, the Board further concluded that the nature and duration of the crimes were significant aggravating circumstances. This included the sending of harassing e-mails to the victim which the Board described as “repulsive in nature.” |
