Case Digest In 2003, while on inactive status, Respondent filed a pleading and appeared in court in VA, where he was not licensed to practice and had failed the bar examination three times. At the time he had been admitted to practice in Pennsylvania for two years, was not admitted to practice in any jurisdiction other than Pennsylvania, did not meet requirements to waive into the Virginia bar because he had not been engaged in the active practice of law in Pennsylvania for five years, as required by VA Rules, was eligible for admission to the Virginia bar only if he passed the Virginia bar examination and fulfilled all other requirements for admission; and was not eligible to apply for admission pro hac vice under VA Court Rules. He then lied to the court as to the duration of his admission in PA and the status of his attempts to gain admission in VA. Although Respondent did not respond to the Petition for Discipline or participate in the disciplinary proceedings, he was suspended for five years rather than disbarred as recommended by Disciplinary Counsel.
