Respondent was arrested and charged with Driving Under the Influence of Alcohol in February 2001. He received Accelerated Rehabilitative Disposition (ARD). In December 2001, he was arrested a second time for DUI. Respondent’s ARD was revoked, and he pleaded guilty on both cases. He was sentenced to fines and incarceration for a combined total of 32 days to 23 months. He served 32 days of incarceration. He underwent inpatient treatment for alcoholism, and the parties stipulated that his alcoholism was the cause of his misconduct. Respondent provided evidence that he was participating in Alcoholics Anonymous and undergoing continuing treatment for alcoholism, and that he had retained his employment with a state agency despite his legal problems.
