Respondent had a lengthy disciplinary history in Pennsylvania. He had received an Informal Admonition in 1987, a Private Reprimand in 1988, a Public Censure in 1992, a Private Reprimand in 1995 and an Informal Admonition in 1998. Respondent had a history of failing to keep his clients informed and up to date on the progress of their cases, but the prior instances came during or immediately after Respondent's addiction to alcohol.
The instant matter involves Respondent's failure to correctly file a Post Conviction Relief Act Petition on behalf of his client in violation of Rule of Professional Conduct 1.3, and his failure to adequately communicate with his client about the case in violation of Rule of Professional Conduct 1.4(a). The Hearing Committee noted that Respondent undertook the representation of his client just thirteen (13) months after receiving an Informal Admonition for violations of Rules of Professional Conduct 1.3 and 1.4(a).
