Respondent’s was scheduled to receive a Private Reprimand for violation of RPC 1.3. 1.4(b) and 1.16(d). Respondent willfully failed to appear for the scheduled Private Reprimand or to notify the Secretary of the Disciplinary Board within twenty days of the scheduled Private Reprimand that she wished to institute formal proceedings.
Disciplinary Hearings were held on October 17 and December 17, 2001 before Hearing Committee 1.08. The first hearing was continued in order for Respondent to get counseling and medication to deal with her depression. Respondent failed, without a viable excuse, to take any measures to get help in the 60 day continuance period.
Respondent had been on inactive status since December 2000, due to failure to comply with Continuing Legal Education requirements. Respondent also has a prior history of discipline consisting of two informal admonitions in 1997 and a private reprimand in 2001. |
