Respondent was apprised via DB-7 of allegations of misconduct that included neglect and conversion. Respondent’s counsel advised ODC that in counsel’s opinion, respondent was not capable of defending himself against the allegations. Counsel provided ODC with a letter from Respondent’s Psychiatrist who opined that respondent was mentally incapacitated and not competent to assist counsel at the present time. Pursuant to Rule 301(e), Pa.R.D.E., and 91.75(b) of the Disciplinary Board Rules, ODC then forwarded the letter, along with A Certificate of Admission of Disability by Attorney (Form DB-21) to the Prothonotary of the Supreme Court of Pennsylvania. The Court then ordered respondent transferred to inactive status pursuant to Rule 301(e), Pa.R.D.E. All pending disciplinary proceedings are held in abeyance. |
